1. Acceptance of Terms
By accessing or using PC SafeLock services, you agree to be bound by these Terms and Conditions.
If you do not agree, you must not use our services.
2. Description of Services
PC SafeLock provides managed cybersecurity and IT support services, including but not limited to:

Antivirus and endpoint protection

System monitoring and alerting
-
Patch management
-
Data backup services
-
Remote access and support
-
System optimization
Services may be delivered using third-party providers and software platforms.
3. Third-Party Service Providers
PC SafeLock utilizes third-party providers, software platforms, cloud services, security tools, communication systems, and infrastructure providers, including but not limited to:

-
SentinelOne
-
Splashtop
-
Zendesk
-
n8n
-
NextDNS
-
Guardz
-
Microsoft 365
-
QuickBooks
-
Payment processors
-
Cloud hosting providers
-
Internet service providers
-
Domain and DNS providers
Additional providers may be added, changed, or replaced at any time without notice.
You acknowledge and agree that:

These providers operate independently of PC SafeLock.

PC SafeLock does not own, manage, or control the infrastructure, security, availability, software development, policies, or operations of third-party providers.

Service functionality, monitoring, backup, cybersecurity, remote access, ticketing, reporting, communications, automation, and other features may depend on third-party systems.

Service interruptions, delays, outages, data loss, configuration errors, software defects, security incidents, false positives, false negatives, service degradation, or other issues may occur within third-party systems.

Third-party providers may modify, discontinue, restrict, suspend, or change services, features, pricing, integrations, APIs, functionality, or availability without notice.

PC SafeLock cannot guarantee the availability, accuracy, security, reliability, performance, or continued operation of any third-party service.
To the maximum extent permitted by law, PC SafeLock shall not be liable for outages, service interruptions, software defects, security incidents, data loss, data corruption, delayed communications, automation failures, backup failures, monitoring failures, DNS filtering issues, remote access issues, API failures, integration failures, billing issues, or other damages arising from or related to the actions, omissions, failures, vulnerabilities, or limitations of third-party providers.
4. No Warranty & No Guarantee of Security
ALL SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
PC SafeLock makes no guarantees that:

Systems will be free from malware or cyber threats
-
Data loss will not occur
-
Services will be uninterrupted or error-free
Cybersecurity is inherently uncertain.
👉 You acknowledge that no solution can provide 100% protection.
5. Backup & Data Loss Disclaimer
Backup services are provided as a convenience only.
PC SafeLock does not guarantee:

Backup success
-
Backup completeness
-
Backup availability
-
Successful restoration
5A. Backup Scope & Protected Data Locations
Certain PC SafeLock plans, including PC SafeLock HM+, PC SafeLock Office, and PC SafeLock Office+, include managed backup services.
Backup services are configured according to the active backup plan and any additional locations specifically requested by the customer.
Standard backup configurations are designed to protect common user data locations and may not include all files, folders, drives, applications, databases, or storage locations on a device.
You acknowledge and agree that:

PC SafeLock does not automatically know where all customer data is stored.

Files stored outside configured backup locations may not be included in backups.
-
Specialized application data, accounting software data, tax software data, databases, business software data, external drives, network shares, cloud storage locations, and custom folders may require additional configuration.

It is the customer's responsibility to identify and disclose all important files, folders, drives, databases, and storage locations that require backup protection.

Backup configurations are based on information provided by the customer during onboarding and throughout the service relationship.

PC SafeLock is not responsible for identifying undisclosed data locations or determining which files are critical to the customer's personal or business operations.

Customers should periodically review their backup requirements and notify PC SafeLock of any changes to storage locations, software, devices, or business processes that may affect backup coverage.
Failure to disclose important data locations may result in files not being included in backups.
PC SafeLock shall not be liable for the loss, corruption, unavailability, or inability to restore data stored in locations that were not specifically configured for backup protection.
You are solely responsible for:

Identifying all data, folders, drives, applications, and storage locations that require protection.

Notifying PC SafeLock of any changes that may affect backup coverage.
-
Maintaining independent backups where required by your personal, business, legal, or regulatory requirements.
👉 PC SafeLock is not liable for any corrupt files, data loss, corruption, or restoration failure.
5B. System Health, Performance & Pre-Existing Conditions
PC SafeLock services are designed to operate on reasonably functional and maintained Windows and macOS devices.
While PC SafeLock may improve system stability, security, maintenance, patch compliance, backup reliability, and overall performance through automated monitoring, patching, optimization, backup, and security management, results may vary depending on the condition of the device at the time services are installed.
You acknowledge and agree that:

PC SafeLock is not intended to repair existing hardware failures, operating system corruption, software corruption, malware damage, or other pre-existing issues.

Devices experiencing hardware defects, failing storage drives, memory failures, overheating, operating system corruption, severe malware infections, software conflicts, unsupported configurations, or other significant issues may require repair before PC SafeLock services can function as intended.
-
Performance improvements are not guaranteed and depend on the overall health, age, specifications, configuration, and condition of the device.

PC SafeLock does not guarantee that a device will operate faster, perform better, or be free of errors after service installation.
-
Additional repair, remediation, upgrade, optimization, consulting, or support services may be required to address pre-existing conditions discovered during onboarding or ongoing monitoring.

Recommendations provided by PC SafeLock regarding hardware replacement, hardware upgrades, operating system upgrades, software remediation, or system repairs are the responsibility of the customer to approve and implement.

During onboarding, monitoring, patching, backup, optimization, security scanning, or routine maintenance activities, PC SafeLock may discover or report hardware, software, security, performance, configuration, operating system, backup, or data integrity issues that existed prior to service installation. The identification, reporting, or visibility of such issues does not indicate that PC SafeLock caused, contributed to, or created the condition.
If PC SafeLock identifies significant hardware, software, security, operating system, backup, or configuration issues that impair service effectiveness, PC SafeLock may recommend corrective actions before continuing certain services.
PC SafeLock services are intended to maintain, monitor, secure, optimize, and protect supported devices. These services are not a substitute for professional repair services when a device is experiencing hardware failure, software corruption, operating system instability, or other significant pre-existing issues.
PC SafeLock shall not be liable for performance issues, instability, hardware failures, software failures, data loss, service limitations, or reduced effectiveness resulting from conditions that existed prior to service installation or that remain unresolved after recommendations have been provided.
5C. Monitoring, Alerting & Automated Actions
PC SafeLock utilizes automated monitoring, alerting, remediation, security, backup, patch management, DNS filtering, and automation technologies.
You acknowledge and agree that:

Monitoring systems may not detect every issue, threat, failure, vulnerability, or security event.
-
Alerts may be delayed, incomplete, inaccurate, duplicated, or not generated.
-
Automated actions may fail to execute, may execute incorrectly, or may be affected by device conditions, operating system limitations, internet connectivity, third-party services, software conflicts, or hardware failures.

Security tools may generate false positives or false negatives.
-
Backup, patching, monitoring, security, DNS filtering, automation, and remediation functions are provided on a best-effort basis and are not guaranteed.
PC SafeLock does not guarantee that monitoring, alerting, automation, patching, backup, DNS filtering, or security systems will identify, prevent, mitigate, or remediate all issues, threats, failures, or security incidents.
6. Remote Access Authorization
You authorize PC SafeLock to:

Access your systems remotely
-
Install, modify, and configure software
-
Perform maintenance and troubleshooting
You accept all risks associated with remote access technologies.
7. User Responsibilities
You agree to:

Maintain secure passwords
-
Follow cybersecurity best practices
-
Not disable or interfere with protections
-
Keep systems powered and connected when required
Failure to do so may reduce service effectiveness.
8. Subscription, Billing & Payments
Services are billed on a recurring subscription basis.
By subscribing, you agree:

To automatic recurring billing
-
To timely payment of all fees
-
That unpaid accounts may result in suspension or termination
All payments are non-refundable unless required by law.
9. Service Availability & SLA Disclaimer
PC SafeLock does not guarantee:

Continuous uptime
-
Immediate response times
-
Resolution of all issues
Service interruptions may occur due to:
-
Maintenance
-
Internet outages
-
Third-party failures
-
Cyber incidents
10. Limitation of Liability (MAXIMUM PROTECTION)
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
PC SafeLock shall not be liable for:

Data loss
-
Ransomware or cyberattacks
-
Business interruption
-
Lost profits or revenue
-
Indirect or consequential damages
👉 TOTAL LIABILITY IS LIMITED TO:
The amount paid by the customer in the previous three (3) months
11. Indemnification
You agree to defend, indemnify, and hold harmless PC SafeLock from any claims arising from:

Misuse of services
-
Failure to follow security recommendations
-
Unauthorized access to your systems
-
Violations of applicable laws
12. Arbitration Agreement (CRITICAL)
Any dispute, claim, or controversy shall be resolved by binding arbitration, not in court.

Arbitration shall take place in Tennessee
-
Governed by the American Arbitration Association (AAA) rules
-
Each party bears its own costs unless otherwise determined
👉 You waive the right to a jury trial.
13. Class Action Waiver
You agree that:

Disputes must be brought individually

You waive any right to participate in a class action lawsuit
14. Termination
PC SafeLock may suspend or terminate services if:

Payments are not made
-
Terms are violated
-
Systems pose a security risk
You may cancel according to your subscription terms.
15. Changes to Terms
We may update these Terms at any time.
Continued use of services constitutes acceptance of updated Terms.
16. Governing Law
These Terms are governed by the laws of the State of Tennessee.
